Affiliate Program Terms

These terms govern your participation in the ProHeadshots Affiliate Program. By applying or participating, you agree to these terms in addition to the general Terms of Service.

1. Program Participation

Participation in the ProHeadshots Affiliate Program is by application and approval only. We reserve the right to accept or reject any application at our sole discretion and for any reason. Approval may be revoked at any time.

2. No Guaranteed Earnings

Participation in the affiliate program does not guarantee any income, earnings, or commissions. Results depend on many factors outside our control, including your audience, promotion methods, and market conditions. Past commission amounts do not guarantee future earnings.

3. Commission Eligibility

Commissions are earned on qualifying purchases made by users who arrive through your unique affiliate link. Commission rates are set by ProHeadshots and may vary. Rates, tiers, and eligibility rules may change at any time with notice. Custom commission rates may be negotiated for high-volume affiliates.

4. Attribution & Cookie Duration

Affiliate attribution uses a last-touch model. If a visitor clicks multiple affiliate links, the most recent affiliate link before conversion receives credit. The attribution window is currently 90 days from the initial click, subject to change.

5. Payout Terms

• A minimum payout threshold applies (currently $50 USD, subject to change)
• Payouts are reviewed and processed on a monthly schedule, subject to manual review
• Payout methods may include PayPal or other methods as offered by ProHeadshots
• We reserve the right to delay or withhold payouts pending review for fraud, abuse, or policy violations
• Payout amounts are in USD unless otherwise agreed

6. Commission Reversals

Commissions may be reversed (clawed back) in the following situations:

• The referred purchase is refunded
• A chargeback is initiated on the referred purchase
• The referral is determined to be fraudulent or abusive
• The referred purchase is canceled or voided
• The affiliate violated these terms or the general Terms of Service

If a commission has already been paid out and is later reversed, the reversal amount may be deducted from future payouts or your unpaid balance.

7. Prohibited Conduct

Affiliates may not:

• Self-referrals: Refer yourself, your own accounts, or accounts you control
• Spam: Send unsolicited bulk messages, comments, or communications to promote your link
• Misleading claims: Make false, exaggerated, or misleading claims about ProHeadshots, its results, or earning potential
• Trademark misuse: Bid on ProHeadshots branded keywords in paid search advertising, or register domains that include the ProHeadshots name or brand, without written permission
• Fraudulent activity: Use bots, fake accounts, click fraud, cookie stuffing, or any deceptive method to generate referrals or inflate metrics
• Incentivized clicks: Offer cash, gifts, or incentives to users solely for clicking your affiliate link (incentives tied to actual product purchase may be permitted if disclosed)
• Illegal activity: Promote the Service in any way that violates applicable laws or regulations

8. Coupon & Referral Code Rules

If you are provided with or promote coupon/referral codes in connection with your affiliate activity, you must use them in accordance with the terms of those codes. Do not create unauthorized coupon codes, misrepresent discount amounts, or distribute codes on coupon aggregation sites without permission.

9. Tax Responsibility

You are solely responsible for reporting and paying any taxes owed on affiliate earnings in your jurisdiction. ProHeadshots does not withhold taxes on affiliate payouts. You may be required to provide tax documentation (e.g., W-9 or equivalent) before receiving payouts above certain thresholds.

10. Suspension & Termination

We reserve the right to suspend or terminate your affiliate participation at any time, for any reason, with or without notice. Reasons may include, but are not limited to, violation of these terms, fraud, inactivity, or changes to the program. Upon termination, unpaid commissions may be forfeited if the termination is due to policy violations or fraud.

11. Changes to Program Terms

We may update these affiliate terms at any time. We will make reasonable efforts to notify active affiliates of material changes. Continued participation after changes constitutes acceptance. If you do not agree, you should discontinue participation.
